Alzheimer's Complete Contest Rules
1. No purchase necessary. Enter online at www.mochasofa.com/Alzheimers between Monday, December 31, 2007 and Monday, March 10, 2008 at 9:00am EST complete the contest entry form with all required information, and follow the on-screen instructions to submit your entry. Limit of one entry per person per day. If it is discovered that you attempted to enter more than once per day, all your entries will be void.
2. Neither Transcontinental Media Inc., Alzheimer Society of Canada, nor Dell Canada Inc. ("Dell") (collectively, “Contest Sponsors”) will be responsible for the failure or malfunction of any computer software, hardware or telecommunications equipment affecting participation in or any other aspect of this contest. All entries become the property of Transcontinental Media Inc., which assumes no responsibility for lost, stolen, delayed, damaged or misdirected entriesor for any failure of the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received by Transcontinental Media Inc. on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or down loading any material in the promotion. Transcontinental Media Inc. reserves the right (in its sole discretion) to cancel or suspend this contest should a virus, bug or other cause beyond the reasonable control of Transcontinental Media Inc. corrupt the security or proper administration of thec ontest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion may be a violation of criminal and civil laws, and should such an attempt be made, Transcontinental Media Inc. reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, mutilated, forged, falsified, altered, tampered with in any way, mechanically reproduced, or made through any robotic, automatic, programmed or similar entry duplication method. Proof of sending entry will not be deemed proof of receipt. In the event of a dispute, entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry, provided such person meets the eligibility requirements of these Contest Rules. The “authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. By entering this contest, entrants agree to abide by the Contest Rules.
3. One grand prize and ten secondary prizes available to be won. The grand prize consists of: a new DELL INSPIRON Notebook. Your choice of 1 of 8 colours. Approximate value of grand prize: $1,500. Each secondary prize consists of: $50 gift certificate from your local book store. Approximate value of each prize package: $50. The prize is not transferable or convertible to cash and must be accepted as awarded. Contest Sponsors reserve the right, in their sole discretion, to substitute a prize of equivalent or greater value. Each entrant is eligible to win one prize only.
4. A random draw - from all eligible entries received on or before the contest closing date of Monday, March 10, 2008 at 9:00 a.m. EST - will be made at 12:00 p.m. EST on Monday, March 17, 2008, at 25 Sheppard Ave. West in Toronto. The selected entrants will be contacted by phone, e-mail or postal mail. In order to win, the selected entrants must first correctly answer a time-limited mathematical skill-testing question and winner will be required to sign a standard declaration of compliance and publicity/liability release confirming compliance with the contest rules and acceptance of the prize as awarded, consenting to the use of their name and photo in any contest-related publicity, and releasing the Contest Sponsors from liability. By accepting a prize, the winner consents to the use of his/her name and/or photographs, without compensation, for advertising or publicity. If a selected entrant cannot be contacted, or the required declarations and releases are not received within the prescribed period, or if a potential winner does not comply with these Contest Rules or is deemed ineligible for any reason, the prize will be forfeited and may awarded to an alternate winner. The decisions of the Contest Sponsors shall be final in all matters relating to this contest.
5. By entering the Contest, each entrant accepts these Contest Rules and releases the Contest Sponsors, their respective affiliates, directors, officers, employees and agents from any and all liability arising in connection with the Contest. Winners release the Contest Sponsors, their respective affiliates, directors, officers, employees and agents, from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession and/or use or misuse of any prize.
6. The contest is open only to residents of Canada who have reached the age of majority according to the law of the province in which they reside, except employees of Transcontinental Media Inc., Alzheimer Society of Canada, Dell, their affiliated companies, their representatives and agents, their advertising and promotional agencies, the contest judges, and all persons domiciled with any of the above.
7.The chances of being selected depend upon the total number of eligible entries received. This contest is subject to all applicable federal, provincial and municipal laws. Contest Sponsors reserve the right, subject to the approval of the Régie des alcools, des courses et des jeux in Quebec, to terminate this contest or to amend the contest rules at any time without notice.
8. All entries become the property of Transcontinental Media Inc. The information on the entry forms will be used to administer this contest and in connection with any publicity relating to this contest, and unless you opt out on the entry form, Contest Sponsors will also use your information to provide you with information about their products, services and promotions and with advertising and marketing material which the Contest Sponsors believe may be of interest to you. 9. For Quebec Residents Only: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
