Clairol Perfect 10 Contest ~ Rules and Regulations

1. To Enter and qualify, starting July 9, 2008, 12:00 pm (EST), until 11:59 pm (EST) on August 20, 2008 complete the on-line contest entry form at www.mochasofa.com/perfect10 (links found on www.CanadianLiving.com, www.ElleCanada.com, www.Homemakers.com, www.More.ca and www.StyleAtHome.com) with all required information, and follow the on-screen instructions to submit your entry. Limit one entry per person/email address. If it is discovered that you attempted to enter more than once, all your entries will be void.

2. No purchase necessary. Contest closes August 20, 2008.

3. There will be One (1) prize awarded consisting of round trip economy air fare for two (2) from the Canadian domestic commercial airport nearest the winner’s city of residence and onward to New York City, two (2) nights hotel accommodations (based on double occupancy), a half-day spa package for two (2), $500 spending money, and twelve (12) units of Perfect 10 by Nice 'n Easy. Total approximate retail value of prize: $5,000 CDN based on point of departure. Odds of winning depend on the number of eligible entries received by the contest closing date.
Trip must be taken before November 30, 2008. Some blackout periods may apply. Winner and Guest must depart from the same departure point and must travel together on the same itinerary. Winner is not entitled to any monetary difference between the actual prize and the stated approximate prize value, if any. All other expenses not specifically described herein, including without limitation applicable taxes, fuel/currency surcharges, additional transportation, room service, gratuities, merchandise, telephone calls, insurance, together with any travel documentation and all personal expenses of any kind or nature are the sole responsibility of the Winner and Guest. It is the sole responsibility of the Winner and Guest to obtain all necessary travel documentation, including passports and visas, if applicable, and to comply with any customs and immigration requirements.

By accepting prize, winners agree to release Contest Sponsors, their affiliates, subsidiaries, advertising and promotion agencies, and each of their respective directors, officers, employees, and agents, from any and all liability, loss or damage of any kind incurred with respect to participation in this promotion, the awarding, receipt, possession, and/or use or misuse of any prize, or participation in prize-related activities. The prize is not transferable or convertible to cash and must be accepted as awarded except in Contest Sponsors sole discretion. Contest Sponsors reserve the right, in their sole discretion, to substitute a prize of equivalent or greater value at any time during the promotion.

4. Selection Process: Winner will be selected by random draw from among all on-line eligible entries received by the contest closing date. The draw will be held at 11:00am (EST) on August 27, 2008 in Toronto (Ontario). Selected entrant will be contacted by phone, or email. To be declared a winner, the selected entrant must first correctly answer a time-limited mathematical skill-testing question and complete a standard declaration of compliance and publicity/liability release confirming compliance with the contest rules and acceptance of the prize as awarded.

5. In the event that a potential winner (a) cannot be contacted by the Contest Sponsors within seven (7) business days following the draw, (b) does not correctly answer the mathematical skill testing question within the time limit, (c) does not sign and return the release forms by September 8, 2008, or (d) is deemed ineligible for any reasons, the Contest Sponsors shall have the right to disqualify that potential winner and to select an alternate potential winner by random draw from among all remaining eligible entries received and the Contest Sponsors shall be fully and completely released and discharged from any and all liability or responsibility in this regard.

6. No correspondence will be entered into except with potential winners. Sponsor accepts no liability for printing errors on material distributed for this contest.

7. Eligibility: To enter and be eligible to win, a person must be a legal resident of Canada, excluding the Province of Quebec, of the age of majority in their province or territory of residence, and not be an employee of, a member of the immediate family of or domiciled with an employee of Transcontinental Media, Procter & Gamble Inc., or their advertising and promotional agencies. All entries become the property of Transcontinental Media and Procter & Gamble Inc.

8. Entrants agree to abide by the contest rules and the decisions of Transcontinental Media and Procter & Gamble Inc., which are final. Prize will be awarded and delivered to the confirmed winner by the handling house. Winner will be required to release Procter & Gamble Inc., Transcontinental Media, and their agencies and representatives from liability with respect to the contest and the prize. An affidavit of eligibility and release must be executed. Failure on the part of the selected entrant to return the affidavit by the deadline as noted on the release form may result in disqualification of that person and an alternate winner will be selected from among all remaining eligible entries. Winner agrees to authorize Transcontinental Media/Procter & Gamble Inc. to announce and publish his/her name, address (city only), and photograph in any forthcoming publicity (including a winner’s list) in connection with this promotion without further remuneration.

9. Neither Transcontinental Media Inc. nor Procter & Gamble Inc. (collectively, “Contest Sponsors”) will be responsible for the failure or malfunction of any computer software, hardware or telecommunications equipment affecting participation in or any other aspect of this contest. All entries become the property of Transcontinental Media Inc., which assumes no responsibility for lost, stolen, delayed, damaged or misdirected entries or for any failure of the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received by Transcontinental Media Inc. on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or down loading any material in the promotion. Transcontinental Media Inc. reserves the right (in its sole discretion) to cancel or suspend this contest should a virus, bug or other cause beyond the reasonable control of Transcontinental Media Inc. corrupt the security or proper administration of the contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, Transcontinental Media Inc. reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, mutilated, forged, falsified, altered, tampered with in any way, mechanically reproduced, or made through any robotic, automatic, programmed or similar entry duplication method. Proof of sending entry will not be deemed proof of receipt. Entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry, provided such person meets the eligibility requirements of these Contest Rules. The “authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. By entering this contest, entrants agree to abide by the Contest Rules.

10. Contest is subject to all applicable Federal, Provincial and Municipal laws.

11. The winner’s name can be obtained by sending a self-addressed stamped envelope before August 20, 2008 to Transcontinental Media, re: Nice ‘n Easy Perfect 10 Contest Winner, 25 Sheppard Avenue West, Suite 100, Toronto, Ontario M2N 6S7.
